1. DEFINITIONS1.1 References in these Terms and Conditions to "you" are to the person who buys a car from MY LHD CAR FRANCE Ltd. References to "we," "us," or "our" are to MY LHD CAR FRANCE Ltd. 1.2 These Terms and Conditions apply to all purchases of cars ordered on our website at www.my-lhd.co.uk and bought over the telephone or via email. 1.3 The car is sold to you by MY LHD CAR FRANCE Ltd, which is authorized to accept orders and receive payment on our behalf. The order takes effect fourteen days after the contract has been signed and the terms and conditions accepted, unless it is agreed that the service will start after the payment of the deposit. In such a case, you will not be entitled to cancel the contract. 2. PRICE AND PRICE VARIATIONS2.1 The purchase price is the total price payable by you for the car, including number plates and any optional equipment, accessories, and extended warranty specified in the order. The purchase price includes foreign registration only if agreed in the contract. The cars are sold tax-free; EU registration costs or local tax costs are not included unless stated otherwise. To avoid double taxation, we advise that all taxes are cleared in the country where the car is to be permanently imported and registered. 2.2 We may vary the purchase price due to any increase or decrease in car tax rates, exchange rates, road fund license, and/or value-added tax between the date we accept your order and the date we notify you that the car is ready for delivery. The price does not include registration or local tax costs. MY LHD CAR FRANCE will not be responsible for extra costs due to changes in the laws of the country where the car is imported or the rules that apply to the importation of the car. 2.3 We may vary the agreed part-exchange price based on any increase or decrease in the market valuation of the vehicle or its actual condition when delivered to us, within 8 days of the original information provided. 2.4 For cars to order (imported), the price advertised on our website and quotations sent by email include delivery to our premises in the United Kingdom or France. This includes registration costs in these countries (Carte Grise only for France, but not the pollution or CO2 tax). For stock cars or cars on special offers, delivery and registration costs are not included in the advertised price. 3. PAYMENT TERMS3.1 You must pay the purchase price (less any deposit paid and the value of any part-exchange vehicle) in Pounds Sterling (or agreed currency) by electronic fund transfer (BACS or CHAPS) to MY LHD CAR FRANCE Ltd as soon as possible or within 14 days of our acceptance of your order. 4. DELIVERY AND VEHICLE CONDITION4.1 When you place an order, you can choose to have the vehicle delivered to an address in mainland Great Britain or another agreed location within 30 days following your order unless agreed otherwise. 4.2 Your car will be driven by a company driver unless otherwise stated. You have the option to have the car delivered on a transporter, and you will be advised of the prices for different delivery methods. This also applies to European or Worldwide delivery. 4.3 You can change your chosen delivery method up to 7 working days before the due delivery date, provided you pay the relevant delivery charges upon delivery. 4.4 If you request delivery to an address in mainland Great Britain or another agreed destination, the car may not be perfectly clean and may have suffered wear and tear during the journey. We will not be liable for such wear and tear unless caused by our negligence. The mileage shown on the odometer will reflect the journey's mileage. Second-hand vehicles may have minor wear and tear (e.g., scratches on bodywork or bumper) reflecting the car's age/mileage. 4.5 We will try to deliver the vehicle by the date specified in our confirmation of acceptance of your order, but time is not of the essence for delivery. We will not be liable for any delay in delivery or for any loss (including loss of enjoyment, use, and profit), costs, damages, charges, or expenses caused directly or indirectly by any delay in delivery. 5. TERMINATION5.1 We may terminate the contract if any of the following occur and, where the breach is capable of remedy, you have not done so within 14 days of receiving a written notice from us: 5.1.1 We reasonably believe the contract was formed based on a typographical or arithmetical error (including but not limited to the purchase price or part-exchange valuation). 5.1.2 You fail to pay the purchase price and any other sums due before or when the car is available for delivery. 5.1.3 You fail to collect the car within 14 days of the agreed collection date. 5.1.4 You do not agree on a delivery date and nominate an address within 14 days of us notifying you that the vehicle is available for delivery or collection. 5.1.5 You are unable to or do not accept delivery at your nominated address on the agreed date and did not give us more than five working days' notice. 5.1.6 You breach any of these Terms and Conditions. 5.2 If we give you notice under clause 5.1, we may store the car or have it stored by a third party on terms we think fit, with the reasonable costs of such storage and any additional transportation to be paid by you until we deliver the car to you or terminate the contract. 6. YOUR RIGHT TO CANCEL6.1 The Consumer Contracts Regulations 2013 provide you with the right to cancel the sales agency service contract at any time up to the end of the fourteenth working day beginning with the day after you signed the contract or paid the deposit. Working days exclude weekends and bank holidays. You may cancel the supply of goods contract at any time up to the end of the fourteenth working day beginning with the day you received the car. 6.2 If you wish to cancel the contract, you must write to us with a reasonable explanation for the cancellation via email, and then to our address, which will be confirmed in the email response. 6.3 If the contract is canceled by you in accordance with these Terms and Conditions after delivery of the vehicle, it shall be returned to us at our UK address at your own cost. 6.4 At the time of return or collection of the car, you must provide us with all keys, the V5 registration document, or any other registration documents you were originally provided with, and all optional equipment, accessories, and other documentation and items supplied with the car. The car's mileage shall not exceed 200 km from when it was delivered to you; otherwise, we will charge one pound per kilometer. We will not accept to take back or part-exchange accident-damaged cars, whether repaired or not. 7. CANCELLATION PROCESS7.1 The contract is binding between MY LHD CAR FRANCE Ltd and the buyer, not the supplier. If you cancel the contract after the 14-day cooling-off period following your order, we will charge a cancellation fee of up to 850 or 20% of the total order value, whichever is greater.7.2 If you cancel the contract within 14 days following the delivery of the car, this charge will not apply. However, you must take good care of the car until it is returned to us and agree to any necessary arrangements for us to collect the car if required. 7.3 We will return all sums paid by you in relation to the cancelled car, less any deductions pursuant to Condition 7.1, any sums paid to third parties, and any sums related to services already provided by the date of cancellation, within 30 days of receiving written cancellation instructions. 7.4 If we have taken possession of a part-exchange vehicle from you when you cancel the contract, we may either return the part-exchange vehicle to you or pay you a sum equal to its valuation. 7.5 If you purchased the car through a finance company and cancel the contract, your notice of cancellation will also cancel the agreement between us and the finance company, as well as the agreement between you and the finance company. 7.6 You will not be entitled to cancel the contract if: 7.6.1 The car has suffered any damage not caused by us, unless we agree to accept the return of the car and adjust the refund to cover the cost of repairs and any reduction in the car's value. 7.6.2 You are unable or refuse to return the car to us or permit us to collect it as per Condition 7.3. 7.6.3 The car has been customized to your specifications or clearly personalized (e.g., registration, specifications, or other changes). 7.6.4 You fail to take reasonable care of the car, including increasing the mileage by more than 50 miles/km from the reading recorded on the car handover checklist provided at delivery. 8. LIMITATION OF LIABILITY8.1 Nothing in these Terms and Conditions affects or excludes your statutory rights as a consumer or any other rights that cannot be excluded by law. All other terms implied by law are excluded to the fullest extent permitted. 8.2 We will not be liable for any loss of profit, anticipated savings, loss of enjoyment, or any other consequential loss. 9. PRIVACY, TERMS OF USE, AND COMPLAINTS9.1 By placing an order, you agree to be bound by our Terms and Conditions, which can be viewed by clicking on the Terms and Conditions link on the homepage of our website and reviewing the Visitor Agreement. 9.2 We will collect personal information such as your name, address, telephone number, and email address. We will not share this information with any outside company or persons. 9.3 We will keep your personal information in a secure environment in accordance with the provisions of Principle Seven of the Data Protection Act 1998. 9.4 By supplying your personal information to us, you consent to its use as described in our Privacy Policy and agree to be included on our direct marketing mailing lists. If you do not wish to receive further marketing information or wish to access, update, or correct any inaccuracies in the personal information we hold about you, or if you have any other comments or complaints regarding the contract, please write to us or email us at complaint@my-lhd.co.uk 10. General10.1 We may inform you verbally that the car is available for delivery, but any other notices required in connection with the contract must be in writing and delivered by hand or prepaid first class post (or airmail for notices sent from outside the United Kingdom). We will send notices to the postal address you provide when placing an order or to another address you notify us in writing. Notices sent to us must be addressed to MY LHD CAR FRANCE. Notices will be deemed given at the time of delivery (if delivered by hand), two working days after posting if sent by pre-paid first class post, or seven working days after posting if sent by airmail. Please check our dispute page to resolve any issues arising before or after the order. 10.2 The contract is personal to you and you may not assign or transfer it to any third party without our prior written consent. 10.3 We can transfer our rights under the contract to a third party, but nothing in these Terms and Conditions grants any person who is not a party to the contract any benefit or right to enforce any of the contract terms. 10.4 Except as stated in Condition 1.4, nothing in these Terms and Conditions creates a partnership or agency between us and My Left Hand Drive Car Ltd, or authorizes either party to act as agent or hold itself out as agent for the other. Neither we nor MY LHD CAR FRANCE Ltd have authority to act in the name of, on behalf of, or otherwise to bind the other in any way. 10.5 The display of cars on the website and the provision of any quotation is not an offer to sell you a car. If you wish to buy a car, you must place an order, which we may accept or refuse. We reserve the right to ask you to pay a deposit. If we refuse to accept your order, we do not have to provide a reason. If we do accept your order, the contract will, where you have applied for credit to buy the car, be conditional upon your credit application being accepted. 10.6 All drawings, photographs, illustrations, descriptions, and advertising material on our website are published only to give you an approximate idea of the cars for sale and do not form part of the contract between you and us. 10.7 Your order and the information on the contract are governed by and interpreted in accordance with English law. 10.8 The English courts have jurisdiction to hear disputes between us. |
